A missed EMI feels a lot like a smoke alarm going off in the middle of the night. Loud, sudden, impossible to ignore. But just because the alarm is loud does not mean the house is allowed to be on fire. There are rules for how a lender, and the recovery agents working on its behalf, can respond when a payment is late. If you have taken a loan through mPokket and are now getting calls from a recovery agent, this guide walks you through exactly what is and is not allowed, and what to do next.

## **Who Is Actually Calling You**

mPokket itself is a digital lending platform and Lending Service Provider (LSP), not a bank. It connects borrowers, largely students and young professionals, with RBI-registered NBFC lending partners, including mPokket Financial Services Private Limited and other partner NBFCs, who actually sanction and disburse the loan. Collections on overdue accounts are carried out either by the NBFC's own team or by third-party collection agencies engaged for that purpose. When a "recovery agent" calls you about an mPokket loan, they are acting on behalf of the underlying NBFC, and that NBFC is legally responsible for how that agent behaves.

This matters because it means the call you are receiving is not outside the reach of regulation. It falls squarely under the Reserve Bank of India's rules for how regulated lenders and their agents must conduct recovery, and those rules apply whether the lender is a traditional bank or a digital lending app.

## **The Rules Recovery Agents Must Follow**

The RBI's Fair Practices Code, along with its 2022 circular tightening recovery conduct and its later digital lending guidelines, sets out clear boundaries.

> The RBI's Fair Practices Code, along with its 2022 circular tightening recovery conduct and its later digital lending guidelines, sets out clear boundaries. If you want the fuller picture of what changed and why, [RBI's New Loan Recovery Rules: What They Really Mean For You](https://www.credfix.app/blog/rbi-new-loan-recovery-rules) is a good place to start.

A recovery agent is permitted to:

- Contact you only between **8:00 AM and 7:00 PM**. Calls before or after this window are a direct violation.

- Identify themselves clearly, by name and on behalf of which lender they are calling.

- Discuss the loan only with you, or with a guarantor if one exists on the loan.

- Communicate in a civil, respectful manner.

A recovery agent is **not** permitted to:

- Use abusive, threatening, or humiliating language.

- Threaten arrest or criminal action. Defaulting on an unsecured personal loan is a civil matter, not a criminal offence, and no agent can lawfully threaten you with police action or jail for it.

- Contact your family members, friends, employer, or people from your phone contacts to disclose your loan status or pressure them to make you pay. RBI's digital lending guidelines specifically bar lending apps from accessing a borrower's contact list or photos for recovery purposes, and from sending shaming messages to people in that list.

- Visit or call repeatedly to the point of harassment, or show up at your workplace to embarrass you.

- Make anonymous calls or use rotating numbers to disguise who is calling.

If any of this sounds familiar from a call you have received, it is worth understanding that this is not "how debt collection works." It is a violation of rules the lender itself is bound by.

## **Why the Rules Exist**

Think of it the way you would think about a referee in a football match. A referee does not stop the game because one team is behind on the scoreboard. The referee steps in only when someone breaks a rule of play, tripping, shoving, playing outside the lines. RBI functions the same way here. It does not stop a lender from recovering money that is genuinely owed. What it prevents is the recovery process turning into intimidation. The debt is real; the fear tactics do not have to be.

## **What To Do If You're Getting These Calls**

**1\. Stay calm and keep the loan itself in view.** An overdue mPokket loan does not disappear because the calls stop. If you owe the money, the healthiest first step is usually to check your outstanding balance in the app, understand the exact amount and due dates, and see if a partial payment or a revised repayment plan is possible. Lenders are generally more cooperative with borrowers who communicate proactively than with those who go silent.

**2\. Document every call.** Note the date, time, phone number, and what was said. If a call happens outside the 8 AM to 7 PM window, or involves threats, abusive language, or contact with someone other than you, that documentation becomes the backbone of any complaint you file. Screenshots of SMS or WhatsApp messages count as evidence too, and recording a call you are personally part of is lawful in India.

**3\. Raise it with mPokket or the NBFC's grievance officer first.** Every RBI-regulated lender, including the NBFC behind your mPokket loan, is required to have a Grievance Redressal Officer (GRO) whose contact details are published on the lender's website. Send a written complaint, by email, with dates, details, and evidence attached. This starts a 30-day clock: the lender is expected to respond and resolve the issue within that window.

**4\. Escalate to the RBI if it isn't resolved.** If 30 days pass with no resolution, or the response is unsatisfactory, you can file a free complaint with the RBI through the Complaint Management System portal at **cms.rbi.org.in**, under the Reserve Bank - Integrated Ombudsman Scheme. You will need the lender's name, your loan account details, and a summary of what happened, backed by the evidence you collected.

**5\. File a police complaint for threats or physical intimidation.** If a recovery agent threatens you, your family, or shows up in a way that feels unsafe, this moves beyond a regulatory violation into potentially criminal conduct, and a local police complaint or FIR is an appropriate step alongside your RBI complaint.

**6\. Reach out to the National Consumer Helpline.** The number, 1800-11-4000, logs your complaint independently and creates an additional record of what you experienced, which can support your case as it moves through the other channels.

## **A Quick Word on What Not to Do**

It can be tempting, out of frustration, to simply block every number and stop responding altogether. This rarely helps. An unpaid loan does not vanish, and continued non-communication can affect your credit report and CIBIL score regardless of how the recovery calls were conducted. The better approach is to separate the two issues: address the debt on its own terms through direct communication or a repayment plan, and address any misconduct by the recovery agent through the formal complaint channels above. You are allowed to do both at the same time.

## **The Bottom Line**

Owing money on a loan does not strip away your right to be treated fairly while it is being recovered. If a recovery agent connected to your mPokket loan is calling outside permitted hours, using threats, or reaching out to people who are not party to your loan, that is a rule violation you can document and act on, through the lender's own grievance process, the RBI's Ombudsman scheme, or the police, depending on how serious it is. The debt is yours to resolve. How you are treated while resolving it is something the regulator has already decided is not up for negotiation.
## FAQs
Q: What hours can a recovery agent legally call me?
A: Only between 8:00 AM and 7:00 PM. Calls outside this window are a direct violation of RBI's Fair Practices Code.

Q: Can a recovery agent contact my family, friends, or employer?
A: No. Agents can only discuss the loan with you or a guarantor. RBI's digital lending guidelines specifically bar lending apps from accessing your contacts or shaming people connected to you.

Q: Can a recovery agent threaten me with arrest?
A: No. An unpaid personal loan is a civil matter, not a crime, and no agent can lawfully threaten arrest or police action over it.

Q: What should I do if a recovery agent breaks these rules?
A: Document every call, date, time, number, and what was said, then file a written complaint with the lender's Grievance Redressal Officer. If unresolved after 30 days, escalate to the RBI's Complaint Management System at cms.rbi.org.in.

Q: Should I just block the recovery agent's number instead?
A: It's not advisable. The debt itself won't disappear, and ignoring it can hurt your credit score. It's better to address the loan directly while separately reporting any misconduct through official channels.
